These terms and conditions of sale apply to the use of and the purchase of goods through the website at towerhighlearning.com (the “Website”).

Contracting with Us

When you place an order with us, you are making an offer to buy goods (Montessori materials). We will send you an automated email to confirm that we have received your order. Once we have checked the price and availability of the goods, we will email you again to confirm that we have accepted your order and at that point a contract has been made between us. We take payment for the goods requested before we have accepted your order, but we do this for ease of administration and it should not be seen as the contract being formed at payment stage.

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order and there will be no contract between us. If you decide not to proceed with the purchase, you will be given a full refund.

How to place an order

Once you have selected the product(s) you wish to buy from the Website, you will be asked to create an account or continue as a guest. You must provide us with personal data (which will be held in accordance with our Privacy Policy, which will include name, delivery address and payment billing address.

You will be guided through several screens where you should input the relevant details. Once you have provided all the relevant information you can confirm your order. Doing this will take you to our payment gateway, whose secure systems will allow you to make payment for the goods you have requested. Payment will be taken immediately. However, a contract is only created once we have accepted your order and emailed you to confirm that your order has been accepted.

If you make an input error prior to placing an order, you can go back to the previous screen and amend the relevant details. If you realise you have made an error in the details you have provided after you have paid, then please email info@towerhighlearning.com or call 01623 723089.

If once you place your order we contact you to say that we do not have that item in stock or that the price has changed, you will be entitled to ask for a full refund of all charges without any question.


We deliver to the UK (which includes Wales, Scotland, Northern Ireland) and selected countries listed on the website.

We will  deliver to the delivery address stated in your website order. Should this address be wrong all charges incurred will be payable by the customer.

Postage will be worked out using our next day courier service. We do use other courier services so please contact us to request an alternative quote. If no contact via email has been made prior to receiving payment we will send according to the stated delivery and the associated charges.  We will do our best to get your item to you as quickly as possible. We usually post 1 to 2 days after receiving payment. If you wish to buy more than one item please contact us before completing payment and we will calculate the combined postage cost and send you a reduced invoice. If you need your items urgently please email us for a quote for express delivery.

Please contact us before placing an order if you require any other delivery methods, such as courier or internationally.

Royal Mail “aims to deliver most First Class mail by the next working day, including Saturdays” although it could take up to 7 days for an item to be delivered. By placing an order you agree that we are not responsible for late delivery and that, unless specifically requested or advised, time of delivery is not of the essence of any contract between us.

If goods are lost or damaged in transit, please advise us as soon as possible and in the case of damage, no more than 48 hours after receipt of such goods. You will need to make a claim against Royal Mail (or other applicable delivery company) in such circumstances and you agree not to hold us liable and await compensation from the Royal Mail/other company. The reason you need to make the claim is because if we make the claim we only get paid the cost price of the product, not the retail price.

We may, at our absolute discretion, consider a refund or return and exchange for goods damaged in transit.

Cancellation and Returns


From 13 June 2014, the Consumer Contracts Regulations, which implement the Consumer Rights Directive in UK law, came into effect. The regulations apply to items bought online, at a distance, or away from a trader’s premises.

Your right to cancel

You have a right to cancel an order for goods which starts the moment you place your order and ends 14 days from the day you receive your goods.

If you decide to cancel within this period, you must then return the goods in a saleable condition within a further 14 days.

Returning goods after cancelling an order is at your own expense.

You will receive a refund within 14 days of either us receiving the goods, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner.

A deduction in your refund may be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary. The extent to which a customer can handle the goods is the same as it would be if you were assessing them in a shop.

Your refund may include delivery costs from the original order. However, if you opted for an enhanced service (for example, guaranteed next day delivery) we will only refund the basic delivery cost.

If delivery was was not charged in the original order, no refund for delivery costs will be made.


If your item is faulty

If your goods are faulty when you receive them and wish to return them, you must do so within 30 days of receiving them to receive a full refund.

The cost of returning faulty items will be met by us.

If the goods are returned more than 30 days after you have received them, we will repair or replace the goods – the choice of a repair or a replacement is down to you. However, if your choice is disproportionately expensive compared to the alternative, we can refuse your choice.

If the attempt at a repair or replacement is unsuccessful, you can then claim a refund or a price reduction if you wish to keep the product.

Electronic Communication

When you visit the Website or send emails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.


We will not be responsible for any loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed, if we breach any terms of the contract between us. We do not limit in any way our liability in law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.

Alterations to these terms

We may make changes to these terms and conditions at any time. You will only be subject to the terms and conditions presented to you at the time of each purchase.

Governing law and jurisdiction

These conditions are governed by English Law.

Entire agreement

These terms and conditions govern our relationship with you. You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation unless a representation has expressly been made a term of the contract between us and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

This privacy policy sets out how Tower High Learning Limited (“We”, “us”) uses and protects any information that you give us when you use this website.

Tower High Learning Limited is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

We may change this policy from time to time by updating this page, although we will email existing customers if you have given us permission to contact you . You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 14/1/2013.
